Stein Mart sued over allegations of false advertising

Marilyn Sperling of California has filed a lawsuit against Stein Mart Inc. over claims of deceptive advertising of its sales.

Marilyn Sperling, individually and for all others similarly situated, filed a class action complaint July 15 in U.S. District Court Central District of California Eastern Division against Stein Mart Inc., alleging false advertising and unfair, fraudulent, and unlawful business practices.

The complaint alleges that Stein Mart stores offer significantly discounted prices on name-brand products.

Price tags in Stein Mart stores suggest customers compare their prices to higher comparative prices, but the complaint alleges that these comparative prices are false.

Sperling and others in the class seek restitution and court costs, plus an order preventing Stein Mart from continuing to engage in the above allegations.

Sperling is represented by Christopher J. Morosoff of Palm Desert, Calif., and by Douglas Caiafa of Los Angeles.
