Women sue Kohl's over allegedly false advertising

SAN DIEGO (Legal Newsline) - Two Chula Vista, Calif., women are suing Kohl's, alleging false advertising of its exclusive brand and private label products.

Wendy Chowning and Lourdes Casas, individually and for all others similarly situated, filed a class action complaint July 21 in U.S. District Court for the Southern District of California against Kohl's Department Stores and Kohl's Corp., alleging false advertising and unfair competition.

The complaint alleges that Kohl's advertises its exclusive and private label products as marked-down or on sale as compared to its advertised original prices. The complaint also alleges that there are in fact no original prices and the "marked-down" or "sale" prices are fake.

As a result, the plaintiffs were led to believe they purchased products that had sold at a previously higher price and suffered financial loss, according to the claim.

The plaintiffs seek an order enjoining Kohl's from utilizing false or misleading "original" prices, as well as restitution and court costs. They are represented by James P. Frantz, William P. Harris III, and George T. Stiefel III of Frantz Law Group, APLC in San Diego.
