American Eagle sued over text messages

CHICAGO (Legal Newsline) - A California man brought a class action lawsuit against American Eagle Outfitters, Inc. on Jan. 21 alleging the clothing retailer sent out unsolicited text messages.

Walter Wood, of Santa Barbara County, alleged that the company did not have prior consent to send the text messages, which violates the Telephone Consumer Protection Act.  



Between Dec. 12 and Jan. 16, Wood allegedly received at least five text messages on his cell phone regarding the sale of the store's Aerie brand, a women’s line of undergarments and lingerie.

Alleging that he and others who received the messages were caused aggravation, plus had to pay for  receiving the texts through their respective wireless carriers, Wood is seeking actual and statutory damages, attorneys fees and costs and an injunction requiring American Eagle Outfitters to cease unsolicited messages.
