ST. LOUIS (Legal Newsline) - A Missouri man filed a class action lawsuit against DISH Network, alleging the company should have lowered his bill for blacking out certain stations.
Plaintiff Craig Felzien is seeking class action status for all DISH Network customers between Oct. 21 and Nov. 20. During this period of time, the satellite company blacked out broadcasts on some stations, including CNN, Headline News, the Cartoon Network, Adult Swim, TruTV, Turner Classic Movies, Boomerang, The Hub and CNN en Espanol.
The company was in contract negotiations earlier this year with Turner Broadcasting System before the talks collapsed and DISH blacked out the channels starting on Oct. 21. The programs returned on Nov. 20 after a deal was reached.
Felzien alleges DISH Network continued to advertise that it carried the channels in its TV packages available to customers despite the programs being blacked out.
The lawsuit alleges DISH Network doesn't disclose in its ads that it can change or delete programming that a customer pays for without crediting the customer's account.
Felzien said he is entitled to a credit on his bill covering the time the Turner programs were not available.
