Sports55 customers to receive restitution

BALTIMORE (Legal Newsline) - Customers of the company Sports55 will receive restitution under a settlement reached on Wednesday with Maryland Attorney General Douglas F. Gansler after the company allegedly failed to deliver orders or sent incomplete or incorrect orders.

The settlement comes after a suit was filed against custom sports uniform providers Sports55 Inc., Teamuniforms123 LLC, Dyesubsports LLC, and two of its owners, Kelly Burke and John Eberl.

Sports leagues that ordered their uniforms from the company were required to make a full payment at the time they placed the order with a promise that they would receive delivery within four to eight weeks.

According to a report by the attorney general's Consumer Protection Division, the company had an undisclosed policy that no refunds would be given, even if the order was not received, or was incomplete or incorrect, Gansler said.

The division also alleged that with so many dissatisfied customers, Sports55 changed its name to Dyesubsports and again to Teamuniforms123.

In addition to the restitution to dissatisfied customers, the company will also pay a $100,000 civil penalty. The civil penalty may be reduced if the company complies with the requirements of the settlement. Under the settlement, an additional $25,000 fee will be paid to the Consumer Protection Division.
