Arizona flooring company to pay nearly $100K for violating state home solicitation law

An Arizona flooring company will pay nearly $100,000 in penalties to settle a lawsuit that claimed the company failed to notify customers they had the right to cancel purchases within three business days, said Arizona Attorney General Mark Brnovich.

Brnovich made the announcement on the settlement with Express Home Services on Friday. The lawsuit alleges that the company's salespeople lied to customers claiming purchases couldn't be canceled for a variety of reasons. Some of the reasons included that the material had already been cut, the sale was a closeout special, the purchase was specially ordered, or due to the installation being the next day, Brnovich said. The company also does business as Express Flooring.

“No Arizona consumer should ever be told to forfeit their consumer rights,” Brnovich said. “My office will continue to pursue business owners who are making false representations to hardworking taxpayers. If you’ve been the victim of unscrupulous business practices, my office wants to hear from you.”

Arizona state law requires businesses that engage in home solicitation to notify customers of their right to cancel within three business days of the purchase. In the settlement agreement, Express Flooring agreed to pay $94,050 in civil penalties and about $5,000 in court and attorneys fees.
