Pennsylvania AG sues home improvement company for failing to fulfill contracts

A York County home improvement company are being sued for failing to complete barns it had contractually agreed to build, said Pennsylvania Attorney General Kathleen Kane.

Kane announced the lawsuit this week against National Barn Co. LLC and its owner Lowell Thomas II. The lawsuit was filed by the attorney general's Bureau of Consumer Protection in in York County Court of Common Pleas by Deputy Attorney General Allison Deibert.

The lawsuit claims National Barn entered into contracts to build pole barns, and even accepted “substantial sums as payment” for those projects. However, Thomas failed to deliver materials or build the barns.

The lawsuit also claimed some customers received notices that stated they had breached their contracts even though no breach had occurred. Kane also accused Thomas of misleading customers when it came to the time frame of when their barns would be built.

In all, Kane's office received 27 complaints about the company, of which 14 came from Pennsylvania and the others coming from Ohio, Delaware, New Jersey, New York, Maryland, Virginia and West Virginia.

The lawsuit is seeking a $1,000 civil penalty for each violation and $3,000 for violations involving customers 60 years old or older.

Kane is also seeking restitution for customers who gave Thomas money, and to prohibit him from offering home improvement services in the state.
