Settlement approved over discharge of pollutants into Wisconsin stream‏

MADISON, Wis. (Legal Newsline) - Attorney General J.B. Van Hollen has announced that a construction has agreed to pay $12,000 resulting from the unlawful discharge of pollutants into the waters of a stream that flows into Rocky Creek in Woody County in 2008.

Don Nikolai Construction & Supply Inc., and Donald P. Nikolai agreed to pay the $12,000 in penalties and costs following an investigation conducted by the Wisconsin Department of Natural Resources. The DNR referred the matter to the Wisconsin Department of Justice for prosecution.

Nikolai Construction and Donald Nikolai were named as defendants in a civil enforcement action of environmental protection laws.

The settlement agreement entered into between the Wisconsin Department of Justice and the defendants was approved on December 22 by Wood County Circuit Court Judge Too P. Wolf.

"For the protection of Wisconsin citizens and our natural environment, the Wisconsin Department of Justice will continue to work with DNR to ensure that Wisconsin environmental laws are followed," Van Hollen said.
