Mo. AG gets injuction against owner of gas stations

JEFFERSON CITY, Mo. (Legal Newsline) - Missouri Attorney General Chris Koster announced on Tuesday that he has obtained an injunction against the owner of three gas stations who allegedly violated underground storage tank regulations.

Under the terms of the injunction, Huntley Summers, the owner of three gas stations in Benton and Henry counties, is prohibited from selling petroleum and accepting deliveries of petroleum. The restrictions will be lifted if Summers obtains insurance or another appropriate financial responsibility mechanism.

Koster filed a lawsuit against Summers on May 17, alleging that the owner of Two Brothers Trading LLC was operating his businesses without the insurance required by the state's Underground Storage Tank Law. The law requires gas stations to maintain adequate insurance to pay for bodily injury or property damage resulting from potential underground tank leaks.

Summers' three businesses include Clinton BP, Clinton Bullseye and Warsaw Bullseye.

"Underground storage tanks that are not in compliance with the law can pose a serious health threat," Koster said. "This legal action is necessary to ensure the health of all Missourians."

The injunction gives the Department of Natural Resources the authority to secure and lock all fuel dispensers at the three sites until Summers has obtained insurance or provided other proof of financial responsibility for the tanks.
