Koster settles with now-closed auto credit company

JEFFERSON CITY, Mo. (Legal Newsline) - Missouri Attorney General Chris Koster reached a settlement on Monday with McMullen Auto Credit LLC and its owners resolving allegations that the defendants failed to provide titles to customers.

McMullen Auto Credit LLC and owners Jamie McMullen Sr., Jamie McMullen Jr., and Nikki Darlene McMullen also allegedly failed to provide car warranties promised to and paid for by consumers, issued multiple temporary permits for the same vehicle and made unlawful threats of repossession.

Under the terms of the agreement, the defendants are prohibited from ever operating or owning an automotive wholesale business or dealership in Missouri.

The McMullens must also offer to re-purchase six vehicles for which they failed to deliver good title and to refund the total amount of the down payments, trade-ins and installment payments consumers made. The McMullens must pay $12,500 in fines, penalties and costs, along with $7,210 in restitution.

"There are clear laws in Missouri to protect buyers of used vehicles," Koster said. "When these laws are violated we will act aggressively to stop the violations and seek restitution for those harmed."

Shortly after Koster filed a lawsuit against the defendants in December, the business permanently closed its doors.
