Ohio AG sues window seller

AKRON, Ohio (Legal Newsline) - Ohio Attorney General Mike DeWine announced a lawsuit on Friday against a Twinsburg-based window seller for allegedly violating the state's Consumer Sales Practices Act by failing to deliver agreed upon services.

Regency Windows Corporation closed its doors abruptly in January, leaving multiple consumers with contracts that were unfulfilled, DeWine said. The company offered replacement siding, windows and door services to consumers in Summit County and throughout Ohio.

"Our primary goal is to help consumers get their money back," DeWine said. "Regency Windows knew it was in trouble financially, but it continued to enter into contracts just weeks and even days before it closed. Consumers lost a lot of money and are upset for good reason."

Regency also did business as HomeEnergy MD, which was advertised as a division of Regency Windows Corporation. HomeEnergy offered energy assessments, audits and related insulation and repair services.

On or around Jan. 13, Regency and HomeEnergy shut down abruptly without advance notice to its customers, DeWine says. The business allegedly had more than 80 contracts outstanding for home energy insulation, warranty work and/or window installation at the time of its closing. Since the business closed, DeWine's office has received more than 200 complaints about Regency and HomeEnergy.

DeWine's lawsuit, filed in the Summit County Court of Common Pleas, alleges that Regency Windows Corporation and HomeEnergy MD engaged in multiple violations of the state's Consumer Sales Practices Act. Allegations include failure to deliver promised services and goods, failure to provide refunds and entering into contracts knowing that consumers were not likely to receive a substantial benefit from the transaction. DeWine's lawsuit seeks civil penalties, permanent injunctive relief and consumer restitution.
