JEFFERSON CITY, Mo. (Legal Newsline) - Missouri Attorney General Chris Koster filed a Clean Water Law violation lawsuit against the owner of two Boone County businesses on Thursday.
Michael Gilbane owns and operates Gilbane Mobile Home Park and Gilbane Rebuilders, which are served by lagoon wastewater treatment facilities that allegedly lack permits. The two treatment facilities discharge to Little Cedar Creek, which is a tributary of Cedar Creek.
Gilbane was also found by the Department of Natural Resources to be in violation of clean water regulations by failing to submit annual Discharge Monitoring Reports since 2005 and by failing to pay annual operating fees since 2006.
"Missourians have a right to expect that waste systems are operated in compliance with the law so they won't pollute our water," Koster said. "Our office will not look the other way when businesses fail to comply with the law."
Koster's lawsuit seeks a preliminary and permanent injunction to prohibit Gilbane from any further Clean Water Law violations. The lawsuit also seeks fees, penalties, costs associated with the case and a civil penalty that is not in excess of $10,000 per day for each violation of the Clean Water Law.
