Pa. company to pay $75K penalty to EPA

PHILADELPHIA (Legal Newsline) - The Region 3 office of the U.S. Environmental Protection Agency announced Thursday that ST Products of Duncansville, Pa., will pay a $75,000 penalty for allegedly exceeding permit limits.

The EPA's complaint alleged the company exceeded its pretreatment permit discharge limits for oil, grease, zinc, lead, and copper during a 34-month period. The industrial wastewater pollutants went to the wastewater treatment plant operated by the Borough of Hollidaysburg in Frankston Township in Blair County. The BOH wastewater treatment plant discharges treated wastewater to the Juniata River which flows into the Susquehanna and ultimately the Chesapeake Bay.

ST Products did not admit liability for the alleged violations, but has certified that it is now in compliance with applicable Clean Water Act requirements.

The EPA has been criticized by federal judges the past two months for its enforcement of pollution regulations. It has been said that the EPA exceeded its authority regarding two enforcement actions. One involved the Clean Water Act and the other the Clean Air Act. Some have expressed concern the EPA is too zealous.

ST Products did not respond to requests for comment about the penalty.
