Ethanol producer settles with Wis. AG

MADISON (Legal Newsline) - Wisconsin Attorney General J.B. Van Hollen announced a settlement on Friday with a Jefferson County ethanol producer for allegedly violating Wisconsin air pollution laws.

Valero Renewable Fuels Company LLC allegedly violated Wisconsin air pollution laws beginning in February 2010 through June 2010 when it operated its facility in violation of its air pollution permit and Wisconsin law. The Department of Natural Resources reported violations between Feb. 25, 2010, and Nov. 12, 2010, to Van Hollen's office.

Valero Renewable Fuels Company LLC acquired the Jefferson County plant in early February 2010 from its former owner, a bankrupt company. The plant already had significant compliance issues and at the time was allegedly operating in violation of its permit.

Under the terms of the agreement, Valero will pay $17,000 in forfeitures, statutory surcharges and court costs. The defendant must pay the amount by check to the Jefferson County Circuit Court. Valero is released from any liability as part of the agreement. Jefferson County Circuit Court Judge William F. Hue approved the stipulated settlement and order for judgment on Wednesday. The stipulation is a final and appealable order.
