Report: Va. AG sues over health spa memberships

CHESTERFIELD, Va. (Legal Newsline) - Virginia Attorney General Ken Cuccinelli reportedly filed a lawsuit on Monday against a Chesterfield recreation complex, alleging that the business violated laws governing the sale of memberships to health spas.

SportsQuest allegedly violated the laws by not listing an opening date for a planned Genito Road fitness facility in its marketing materials. The complex also allegedly failed to open by the date it listed in later materials for marketing, Richmond Biz Sense reports.

Cuccinelli's lawsuit requests that the complex refund at least 700 memberships it allegedly improperly marketed and sold for a fitness facility that has still yet to be built.

"Virginia code prohibits a health spa from selling a health spa contract on a prepayment basis without disclosing in the contract the date on which the health club should open," the lawsuit said, according to the report. "The opening date shall not be later than 12 months from the signing of the contract."

The lawsuit alleges that SportsQuest required customers to pre-pay membership fees of $800 to $2,600 each for contracts that were valid for 36 months of access to the facility, the report says.
