Trump companies assessed small penalties

ATLANTIC CITY, N.J. (Legal Newsline) - New Jersey Attorney General Jeffrey Chiesa announced a ruling by the New Jersey Division of Gaming and Enforcement on Thursday, in which Trump Marina, Trump Plaza and KGM Gaming LLC agreed to monetary penalties.

Trump Marina Hotel and Casino and Trump Plaza Hotel agreed to monetary penalties for allegedly violating transactional waiver provisions. Trump Marina agreed to a $35,000 fine and Trump Plaza agreed to a $3,000 fine. KGM Gaming LLC agreed to a fine of $20,000.

Transactional waivers are a requirement as part of the regulations for transactions that involve gaming equipment at a time when the company has a pending application before the division for an industry license for a gaming related service.

"We have strong regulations in place to ensure integrity with casino operations in Atlantic City," David Rebuck, the division's director, said. "We need to make it clear that the division will not tolerate when those regulations are violated."

KGM LLC, an authorized distributor of Ainsworth Gaming Technology-manufactured slot machines, allegedly failed to file compulsory transactional waivers to deliver AGT machines to the casinos. Trump Plaza and Trump Marina allegedly failed to follow procedures required to ensure that a waiver had been filed and approved prior to accepting the AGT machines.

Between the dates of April 20, 2009, and June 19, 2009, there were allegedly seven unauthorized AGT machines on the floor of Trump Marina. The casino saw $215,502 in winnings from the allegedly unauthorized machines. There were allegedly 22 AGT machines on the floor of Trump Plaza from May 7, 2009, to June 16, 2009, with total unauthorized winnings of $181,326.

The division first filed the complaints with the Casino Control Commission, but the matter was referred back to the division after Feb. 1, 2011, for settlement due to a change in regulatory structure.

Ainsworth Gaming Technology was not accused of any wrongdoing in the matter.

"It was with the cooperation and diligence of Trump Marina and Trump Plaza that the violations were uncovered and we commend them for their forthright position in notifying the division," Rebuck said.

Money received from the state as a part of a settlement agreement will be diverted into the Casino Revenue Fund, which supports the education and treatment of compulsive gamblers and programs that benefit people in the state with disabilities and senior citizens.
