Wis. AG wins case over alleged air pollution

MADISON, Wis. (Legal Newsline) - Wisconsin Attorney General J.B. Van Hollen announced on Monday that his office has obtained a judgment on a civil complaint filed against an ethanol production company for alleged air pollution violations.

The civil complaint, filed against United Ethanol LLC, based in Rock County, alleges 15 violations of Wisconsin air pollution laws, including that United Ethanol exceeded the air emission limits of its permit and failed to install, operate and maintain air pollution control equipment.

The civil complaint was filed in Rock County Circuit Court on Oct. 28.

The company agreed to pay $700,000 in combined forfeitures and penalties. In addition, the company will hire a qualified independent environmental consultant who possesses the expertise to conduct a full facility environmental compliance audit that complies with state law.

The order for judgment was signed by Judge James Welker on November 1. Assistant Attorney General Cynthia Hirsch prosecuted the case.
