Wisconsin AG obtains consent judgment over gas sales violations

MADISON, Wis. (Legal Newsline) - Wisconsin Attorney General J.B. Van Hollen announced Friday his office obtained a consent judgment against a gas station convenience store company for an alleged gas sales violations.

Under the terms of the agreement, Krist Oil Co. must pay $65,000 in civil forfeitures, statutory surcharges and attorney fees. Van Hollen obtained the judgment on behalf of the Wisconsin Department of Agriculture, Trade and Consumer Protection.

The consent judgment resolves a lawsuit filed by the state in Oconto County Circuit Court in October 2010. The complaint alleged that Krist Oil offered for sale or exchange certain liquefied petroleum gas cylinders that were represented to contain a net weight of 17 pounds of LP gas. When the cylinders were tested, they were allegedly found to be filled to a net weight of less than 17 pounds and exceeded the maximum allowable variation.

Additionally, the complaint alleged that with certain LP gas cylinders offered for sale or exchange by Krist Oil, the company did not provide a declaration of responsibility attached to the container. It also allegedly failed to conspicuously post a declaration of responsibility at the location where the container was offered or displayed for sale or exchange.

The complaint also alleged that with certain LP gas cylinders offered for sale or exchange by Krist Oil, the company did not disclose on the LP gas cylinders or on a tag attached thereto the net quantity of liquid petroleum gas in each container. This disclosure is required by state law. Additionally, the complaint alleged that with certain LP gas cylinders, Krist Oil offered for exchange or sale LP gas in cylinders that were not plainly, clearly and conspicuously marked with the container's tare weight.

The judgment also imposes certain injunctive relief and directs Krist Oil to submit to DATCP a written statement of the method by which the company will ensure that LP gas cylinders offered for sale or exchange in Wisconsin deliver the net weight of LP gas they are represented to contain.
