NLRB delays implementation of posting rule

WASHINGTON (Legal Newsline) - The National Labor Relations Board is delaying implementation of a controversial new rule for employers.

A notice will be made in the Federal Register about a new effective date -- Jan. 31 -- of the Notice Posting Rule.

The new NLRB rule requires employers to post information about employee rights online and in the workplace. But it does not include information about employee's rights regarding participation in labor unions or illegal practices by labor unions.

The NLRB claimed the delay was for further "public education and outreach" to explain the rule.

However, according to a spokesman for the National Right to Work Legal Defense Foundation the real reason is that organizations such as theirs, the National Federation of Independent Business, and the National Association of Manufacturers are challenging the rule in federal court. NRW filed a preliminary injunction to halt implementation of the new rule.

The court will hear oral arguments on Dec. 19.
