Ariz. AG obtains injunction against solicitations

PHOENIX (Legal Newsline) - Arizona Attorney General Tom Horne announced on Monday that his office has obtained a preliminary injunction against an air conditioning service company prohibiting it from soliciting Arizona consumers by telephone.

Abode Air and owner Ron Dew allegedly violated the Arizona Consumer Fraud Act by repeatedly calling consumers after they asked not to be called and by calling consumers who were on the national Do-Not-Call Registry. After a two-day hearing in which approximately 26 consumers testified, the court specifically found that the company was in violation of the act.

Thousands of consumers have filed complaints with various law enforcement agencies regarding Abode Air's telemarketing practices. The Registrar of Contractors revoked Abode Air's contractor licensed on September 7 for reasons other than telemarketing.

Abode Air is a Tempe-based air conditioning and heating service and installation company. Horne's office and the Better Business Bureau have received hundreds of consumer complaints regarding the company's telephone solicitations, many from senior citizens.

In July, Horne warned consumers of Abode Air and their allegedly deceptive phone practices. Litigation against the company is continuing in Maricopa County Superior Court.
