Consent judgment entered against telemarketer

JEFFERSON CITY, Mo. (Legal Newsline) - Missouri Attorney General Chris Koster announced a consent judgment on Thursday against a Florida-based telemarketing company and its owner for alleged violations of state telemarketing and telephone solicitation laws.

Higher Response Marketing and Craig Rubino, the owner of the company, allegedly made telephone solicitations to Missourians who had their names on the state's No-Call List, claiming that Higher Response Marketing could lower the interest rate on a consumer's credit cards.

Koster's Consumer Protection Division received numerous complaints about the company.

In addition to a $25,000 fine, the judgment prohibits Rubino from making future calls to anyone on the No-Call list and requires him to comply with all federal and state laws regarding telemarketing and telephone solicitations and sales. Violations of the judgment will result in civil penalties.

"The attorney general's office will continue to pursue companies who violate our telemarketing and phone solicitation laws," Koster said. "Missourians subscribe to our No-Call List to avoid being harassed by telemarketers. The law is clear, and I want Missouri citizens to know that this office will aggressively enforce the law."
