BOSTON (Legal Newsline) - Massachusetts Attorney General Martha Coakley announced on Friday that the president and secretary of Wrentham, Mass.-based construction company will pay over $226,000 for alleged violations of the state's wage and hour laws.
Glen Pisani and Dana Pisani, the president and secretary of D.F.M. Industries Inc., will pay $160,000 in restitution and fines of $66,500 for allegedly failing to properly pay employees on multiple Massachusetts construction projects.
The company allegedly failed to pay proper overtime rate to employees who worked over 40 hours in a given workweek, failed to pay employees for hours worked in March on several construction projects and did not pay the prevailing wage on public works projects in the commonwealth.
The Pisanis will pay $131,000 in restitution for steel erection work performed on some public works projects, a $22,000 penalty for violations, a $22,000 citation for failure to submit true and accurate payroll records to the awarding authorities, $26,343.18 in back wages and an additional $22,000 in penalties for failure to make timely payments of wages.
The company filed for Chapter 7 Bankruptcy on March 26, but, under Massachusetts law, employers are held personally liable for the payment of employee wages.
The Massachusetts Wage Act requires employers to pay their employees all earned wages within six days of the conclusion of a pay period. These laws apply to all construction work performed on public works projects in Massachusetts.
