Mo. AG going after Fla. telemarketer

JEFFERSON CITY, Mo. (Legal Newsline) - Missouri Attorney General Chris Koster has filed a lawsuit against a Florida telemarketing company that allegedly solicited calls to individuals on the state's no-call list.

Newspaper Sales Inc., which is based St. Augustine, allegedly violated the Missouri Merchandising Practices Act and the Telemarketing No-Call List Act.

Koster said that the suit followed numerous complaints filed with the No-Call Division of the attorney general's office.

According to the lawsuit, Newspaper Sales allegedly made unauthroized telephone calls to consumers soliciting newspaper subscriptions on behalf of newspapers in the Kansas City metropolitan area.

"When Missourians register with our No-Call list, they do so with the reasonable expectation that they will not receive these unsolicited, harassing calls," Koster said. "These businesses are aware of our No-Call laws, and they are realizing that this office will enforce those laws."

Koster is requesting that the court stop the defendant from making calls to Missourians who are on the no-call list and have no business ties with the company. He is seeking to assess a $5,000 penalty for each violation of the Missouri law, costs associated with the inquiry and prosecution, and all court costs.
