Miller sues over hog manure

DES MOINES, Iowa (Legal Newsline) - Iowa Attorney General Tom Miller announced last week that he has filed a lawsuit against Callaway Farms for allegedly violating state environmental laws.

Miller alleges that the Georgia-based company contributed to water pollution and manure management violations at the Calloway swine finishing operations, located in eastern Hamilton County in Iowa.

Miller filed the lawsuit on behalf of the Iowa Department of Natural Resources, alleging that from Aug. 24-27, 2009, Callaway Farms did not retain hog manure, causing an illegal discharge into the New York Branch of Tipton Creek.

Due to the release, it is alleged that the stream water was discolored, a strong odor appeared and the resulting toxic conditions caused a fish kill.

The suit also alleges that the company didn't notify the DNR of the release in a timely manner.

Miller is seeking a civil penalty and an injunction against Calloway from any future violations, while the state seeks the assessment of civil penalties and an injunction against further violations.
