Idaho AG settles with smoke shop for not having papers to sell papers

BOISE, Idaho (Legal Newsline) - Idaho Attorney General Lawrence Wasden announced a settlement with The Lil' Brown Smoke Shack, an Internet tobacco seller.

Wasden, who filed the lawsuit in 2009, alleged that the tobacco seller sold several tobacco products in violation of Idaho law. The Lil' Brown Smoke Shack is alleged to have sold "roll-your-own" cigarettes that were not on the Attorney General's Directory of Compliant Tobacco Product Manufacturers and Brand Families, according to the lawsuit.

Under Idaho law, only cigarettes, including "roll-your-own" cigarettes, listed on the directory can be sold.

The lawsuit also alleged that The Lil' Brown Smoke Shack sold cigarettes and other tobacco products without holding a tobacco permit from the Department of Health and Welfare, which is required by the Prevention of Minors' Access to Tobacco Act.

Under the settlement agreement, The Lil' Brown Smoke Shack agreed to stop sales unless it receives a permit from both the Department of Health and Welfare and the Idaho State Tax Commission. The company also agreed to stop selling cigarettes not listed in the state directory.

"The Idaho Legislature passed these laws to reduce the illegal sale of tobacco products to children and to address the harmful effects tobacco has on Idaho," Wasden said.

The Lil' Brown Smoke Shack also agreed to reimburse the state's attorney fees for costs related to the action.
