Abbott takes issue with concrete blocks

AUSTIN, Texas (Legal Newsline) - A Texas towing company has been charged by Texas Attorney General Greg Abbott with violating state disability laws, Abbott's office announced on Tuesday.

Abbott filed an enforcement action against Franklin Service Stations, which does business as J & J Towing in southeast Austin, for allegedly failing to upgrade its facility to be accessible for persons with disabilities, which resulted in them not being given a chance to reclaim their towed vehicles.

Abbott claims J&J Towing's public vehicle storage facility on Linger Lane had large concrete blocks at its entrance. Abbott also says the company's payment window is too high for mobility impaired people to use.

The experience of one mobility-impaired person was cited in the enforcement action, detailed the person's difficulties with trying to get his car back because of both of the for mentioned violations.

Abbott is seeking injunctive relief and civil penalties of up to $5,000 per violation from the company, which was charged with violating both the Elimination of Architectural Barriers Act and the Vehicle Storage Facility Act.
