Home security company responds to Minn. AG's lawsuit

OREM, Utah (Legal Newsline) - A home security company recently sued by Minnesota Attorney General Lori Swanson says the allegations against it are untrue.

Swanson's lawsuit alleges that AMP Alarm targeted seniors in order to deceive them into thinking they needed home security products. Chelsey Ellison, the company's customer advocate, says that isn't the case.

"AMP Alarm has never targeted the elderly or any other particular demographic in its marketing," she said.

Ellison added that the company's customers are well-informed before purchasing.

"Before, during, and after each sale of an alarm system, there are at least four separate opportunities for the customer to discuss and understand the alarm monitoring services provided by AMP Alarm," she said.

"The first with the AMP Alarm sales representative, the second with an installation technician, followed by two recorded telephone calls with customer service to review and discuss the terms and alarm services."

Swanson alleges that the company sold home security alarms and related long-term alarm monitoring agreements to seniors on fixed incomes who couldn't afford the fees.

The lawsuit further alleges that customers often were not notified of the disclosures required under the Minnesota Personal Solicitation of Sales Act by the salespeople, which are required by law. It is also alleged that many "bait and switch" tactics were used.

Swanson filed the lawsuit Wednesday.

Ellison said the company will defend itself "vigorously."
