TOPEKA, Kan. (Legal Newsline)-Kansas Attorney General Steve Six must justify a lawsuit he has filed against a district judge over abortion records, the state Supreme Court said Thursday.
The high court gave Six a week to tell the justices why they shouldn't dismiss the lawsuit.
Six has sued Shawnee County District Judge Richard Anderson to force him to return records from an investigation into two abortion clinics: one operated by Planned Parenthood in Overland Park, and the other by Dr. George Tiller in Wichita.
Anderson has the records because he once supervised an investigation into the two abortion providers for allegedly performing so-called later-term abortions. One of Six's predecessors,
Attorney General Phill Kline, began the investigation.
Kline is now the Johnson County district attorney.
The records Six is seeking include edited copies of medical records from about 90 patients' files.
Six has argued that Anderson has no legal reason to hold the records.
