No-Call Act should cover cell numbers, Kansas AG argues

TOPEKA, Kan. (Legal Newsline) - Kansas Attorney General Derek Schmidt said on Wednesday that the Kansas No-Call Act should be expanded to cover Kansans' cell phone numbers.

During a news conference, Schmidt announced that he will propose a bill to update the Kansas No-Call Act to enable his office to enforce violations against telemarketers targeting cell phone numbers registered on the federal Do-Not-Call list. Sen. Pat Apple, R-Louisburg, the chairman of the Senate Utilities Commission, and representatives of Kansas AARP, Verizon, Sprint and AT&T joined Schmidt and voiced their support for the proposed legislation.

"Kansans who register their personal phone numbers on the Do-Not-Call list have an expectation of privacy, whether that number is tied to a landline or wireless phone," Schmidt said. "The Kansas No-Call Act needs to be updated to reflect the reality that many Kansans use wireless phones as their primary - and often only - phone number."

The federal Do-Not-Call database lets consumers register any phone number, but the law in Kansas is not clear about whether Schmidt can pursue violations of the No-Call Act when a call is made to a cell phone number registered on the list. The proposed bill would clarify that the law applies to cell phones as well. It would also update other parts of the law to mirror federal Do-Not-Call regulations.
