Ohio AG takes on home contractor after receiving three complaints

JACKSON, Ohio (Legal Newsline) - Ohio Attorney General Mike DeWine filed a lawsuit on Wednesday against a Wellston-based home improvement contractor who allegedly performed shoddy and incomplete work in violation of state law.

Johnny Poe, who did business as Johnny Poe Construction and JP Construction, allegedly violated Ohio's Consumer Sales Practices Act and Home Solicitation Sales Act. DeWine's Consumer Protection Section received three complaints from consumers who allegedly paid Poe between $4,700 and $42,000 for work that was not completed as promised.

"When you pay someone thousands of dollars for their services, you deserve to get what you pay for," DeWine said. "When businesses fail to live up to their promises, we will hold them accountable."

Poe allegedly failed to provide consumers with a written agreement containing the notice of a consumer's right to cancel within three days, demanded and accepted installation payments and allowed eight weeks to elapse without fulfilling his contractual obligations or providing a refund.

DeWine's lawsuit, which was filed in the Jackson County Common Pleas Court, seeks consumer restitution, injunctive relief and civil penalties.

DeWine reminded consumers that door-to-door sales contractors are required under state law to give consumers a three-day right to cancel and cannot start the work until after the three-day period.
