Ariz. AG files lawsuit against mortgage services company

PHOENIX (Legal Newsline) -- Arizona Attorney General Tom Horne filed a consumer fraud lawsuit Wednesday against a Phoenix-based mortgage services company and its principals for allegedly misleading consumers.



Making All Homes Affordable LLC, Albert Figueroa, the company's owner and manager, and Steve Villanueva, one of the company's salespersons, allegedly targeted Spanish-speaking consumers in need of mortgage modifications and misled consumers into thinking the company's program would reduce principal and interest payments.


The company allegedly misrepresented to consumers that they were eligible and qualified for specific principal and interest rate reductions, when the company had no knowledge as to whether the lender would agree to such reductions.


MAHA allegedly failed to obtain interest rate reductions even after taking consumer payments of approximately $1,700 each for the program.


Figueroa also allegedly worked with the Arizona-based Diversified Home Solutions LLC to fraudulently obtain payment from a MAHA client. Figueroa allegedly recorded a fraudulent deed of trust against the client's property for a nonexistent debt Figueroa claimed was owed to DHS.


Horne's lawsuit requests that the court issue orders against the defendants to prevent them from violating the Arizona Consumer Fraud Act, require them to provide refunds to MAHA consumers and force them to pay civil penalties and attorney costs.
