Ky. AG announces action against headstone seller

FRANKFORT, Ky. (Legal Newsline) -- Kentucky Attorney General Jack Conway announced Friday his office filed a motion against a Central Kentucky-based installer and seller of cemetery monuments and headstones for allegedly failing to comply with a prior consent judgment.



Donald Curtis, doing business as Resource Granite Sales, allegedly failed to comply with a July consent judgment requiring him to install monument orders in a timely manner, make refunds to consumers, provide certain disclosures to consumers when taking advance payments, and report all outstanding contracts to Conway's office.


Conway's office looked into Resource Granite Sales after receiving multiple consumer complaints.


On July 10, a consent judgment was approved by the Franklin Circuit Court to resolve allegations that the business violated the Kentucky Consumer Protection Act.


"Before doing business with a company you are not familiar with, make sure you've done your homework," Conway said in a statement. "Check with the Better Business Bureau or call my Office of Consumer Protection at 1-888-432-9257 to learn more about a business. Also, demand a written contract and never pay in advance."


The motion requests that the court enjoin the defendant from making further sales or contracting new customers until existing contracts are fully refunded or performed. The motion also seeks civil penalties against Curtis.


A hearing on the motion will take place May 8.
