JEFFERSON CITY, Mo. (Legal Newsline) - Missouri Attorney General Chris Koster filed a lawsuit Monday against a Greene County business that allegedly violated the Missouri Cave Resources Act and Solid Waste Management Act by conducting illegal dumping of waste.
Weldon Contractors and Construction LLC and Bryan Weldon, the company's owner, allegedly engaged in the illegal dumping of approximately 100 cubic yards of demolition waste from structures damaged in the Joplin tornado into an abandoned mine shaft in Jasper County. The waste dumped near Neck City could reach surface or groundwater.
Weldon allegedly violated the Missouri Cave Sources Act by illegally introducing solid waste into Missouri subsurface waters through the mine shaft.
"Missouri's natural resources are important to this state and must be protected," Koster said. "No one should be allowed to use a mine shaft as an illegal dump, and those who abuse the environment in this way will be prosecuted."
Koster's lawsuit requests that the court issue a preliminary and permanent injunction to prohibit Weldon and his company from any further Solid Waste Management Law and Cave Resources Act violations. The lawsuit also asks the court to assess a civil penalty of as much as $1,000 per day and court costs against the defendants.
