Ind. AG files suit against contractors allegedly scamming elderly

Indiana Attorney General Greg Zoeller filed a lawsuit on Wednesday against a group of home improvement contractors for allegedly scamming seniors into paying for projects never completed.

The lawsuit filed in Marion County court accuses Hank Eversole, Joe Eversole, Robert L. Eversole and Joseph D. Martin of accepting money for services not rendered. The defendants operated under several business names, including Hank’s Construction, Joe’s Value Construction & Trees and EJ’s Tree & Construction.

The company allegedly targeted senior citizens, including one victim who paid the defendants more than $13,000 for roofing and landscaping services that allegedly were never finished. The defendants allegedly targeted another victim who had Alzheimer's disease for unnecessary repairs, and in one case Zoeller's lawsuit said they altered a $15 check to read $1,500 before cashing it.

“The defendants in this case have demonstrated a ruthless pattern of victimizing the elderly, and they need to be stopped,” Zoeller said. “Tragically, we see this scam all too often. Phony home improvement contractors solicit senior citizens in person, convince them of an urgent repair need, rush them into a decision, and then deliver faulty or incomplete work. Home improvement scams are one of the most common consumer complaints my office receives.”
