SACRAMENTO (Legal Newsline) — A California woman has filed a class action lawsuit against a baby prodcuts business, alleging fraud and negligent misrepresentation.

Dusty Spearman filed a complaint, individually and on behalf of all others similarly situated, Aug. 8 in U.S. District Court for the Eastern District of California against Lifefactory Inc., alleging false claims regarding the contents of its product.

According to the complaint, Spearman suffered monetary damages from purchasing a teething product for her baby that she thought was free of BPA. The plaintiff alleges Lifefactory advertised its products as "BPA free" but laboratory testing shows that baby teethers do contain BPA.

Spearman seeks trial by jury, compensatory, statutory and punitive damages, injunctive relief, interest, restitution, legal fees, and all other relief the court deems just. She is represented by attorneys L. Timothy Fisher and Joel D. Smith of Bursor & Fisher PA in Walnut Creek, California, by Scott A. Bursor of Bursor & Fisher in New York, and by Michael T. Fraser of The Fraser Law Firm PC in Granite Bay, California.
