Consumer accuses milk products company of false advertising

SAN FRANCISCO (Legal Newsline) — A consumer has filed a class action lawsuit against a milk products company, alleging negligent misrepresentation and unfair competition.

Dan Zeiger filed a complaint, individually and on behalf of all others similarly situated, Aug. 4 in U.S. District Court for the Northern District of California against Whitewave Foods Company, alleging false representations regarding its milk products.

According to the complaint, Zeiger suffered damages from purchasing a milk product that does not perform as well as advertised. The plaintiff alleges Whitewave Foods used false claims in advertising that its milk products improve brain function and health in order to mislead consumers into buying.

Zeiger seeks restitution and disgorgement, injunctive relief, order the defendant to engage in a corrective advertising campaign, legal fees and all other relief the deems just. He is represented by attorney Patricia N. Syverson of Bonnett, Fairbourn, Friedman & Balint PC in San Diego.
