Babyganics sunscreen has false SPF number, consumers claim

CHICAGO (Legal Newsline) – Consumers allege that a Babyganics sunscreen misrepresents its protection.

Laura Carroll, Katherine Exo, Armand Ryden and Katharine Shaffer filed a complaint on behalf of all others similarly situated on Aug. 10 in the U.S. District Court for the Northern District of Illinois, Eastern Division against S.C. Johnson & Son Inc. and VMG Partners LLC alleging breach of warranty and other counts.

According to the complaint, the plaintiffs purchased the defendants' Babyganics mineral-based sunscreen lotion or spray with the sun protection factor (SPF) of 50-plus. They allege that their counsel tested the sunscreen and determined the products' SPF factor is no higher than 30.

The plaintiffs hold S.C. Johnson & Son Inc. and VMG Partners LLC responsible because the defendants allegedly misrepresented the SPF number on their products.

The plaintiffs request a trial by jury and seek damages, restitution, interest, all legal fees and any other relief as the court deems just. They are represented by Theodore B. Bell and Carl V. Malmstrom of Wolf Haldenstein Adler Freeman & Herz LLC in Chicago.
