WASHINGTON (Legal Newsline) — Environmental groups are suing the U.S. Environmental Protection Agency, alleging breach of duty and violation of federal law.
Shenandoah Riverkeeper, a program of Potomac River Network, Potomac Riverkeeper Inc., doing business as Potomac River Network, Potomac River Smallmouth Club, and Warren County Chapter of the Izaak Walton League of America filed a complaint May 30 in U.S. District Court for the District of Columbia against EPA Administrator Scott Pruitt and the U.S. Environmental Protection Agency, alleging their failure to disapprove Virginia's deficient list is causing environmental damages and contravenes the Clean Water Act.
According to the complaint, the plaintiffs were damaged by the inability of the EPA to conclude its decision regarding the water standards. The plaintiffs allege the defendants failed to perform their duty causing significant environmental damages to the Shenandoah River in Virginia.
The plaintiffs seek an order directing EPA to disapprove Virginia’s list of impaired water bodies, attorney fees, court costs and all further relief the court grants. They are represented by attorney Jennifer C. Chavez of Earthjustice in Washington, D.C.
