Queens property owners allege MTA released hazardous materials

BROOKLYN, N.Y. (Legal Newsline) — Queens property owners have filed a class action lawsuit against New York's MTA, alleging negligence caused hazardous materials to be spilled on the plaintiffs' property.

Dudley Stewart, as parent and natural guardian of Spike Stewart and Ruby Stewart, Tammy Rose and Eduardo Valentin filed a complaint, individually and on behalf of a class of similarly situated individuals and property owners, May 22 in U.S. District Court for the Eastern District of New York against The Metropolitan Transportation Authority, alleging the defendant allowed hazardous materials to be released from their structures and onto the plaintiffs' property.

According to the complaint, the plaintiffs were damaged from having hazardous materials, notably lead, from Flushing Line elevated trains fall onto their property. The plaintiffs allege the MTA failed to make sure that hazardous materials in its facility does not fall on the plaintiffs' property.

The plaintiffs seek trial by jury, to eliminate all hazards associated with the MTA facility, legal fees and all other relief the court deems just. They are represented by attorneys Steven J. Phillips and Daniel J. Woodard of Phillips & Paolicelli, LLC in New York.
