'Sale' prices on clothing lead to lawsuit

RIVERSIDE, Calif. (Legal Newsline) — A California consumer has filed a class action lawsuit against a clothing company, alleging negligent misrepresentation and unjust enrichment.

Veronica Real of San Bernadino County filed a complaint, individually and on behalf of all others similarly situated, May 4 in U.S. District Court for the Central District of California Eastern Division against Y.M.I. Jeanswear, Inc., IMY, LLC and Does 1 through 50, alleging they made false representation about the discounted prices of their clothing products.

According to the complaint, Real suffered monetary damages from being misled into buying jackets, tops and jeans that were labeled as "sale" The plaintiff alleges the defendants labeled their products as "sale" despite being in its regular price.

Real seeks trial by jury, injunctive and equitable relief, restitution and disgorgement, all profits and unjust enrichment, economic, monetary, actual, consequential and compensatory damages, legal fees, interest and all relief the court deems just.
