TCPA case filed against Flash Advance

SAN DIEGO (Legal Newsline) — A California man has filed a class action lawsuit against a Florida company, alleging violation of telephone harassment statutes.

Christopher Melingonis filed a complaint, individually and on behalf of all other similarly situated, on April 24 in U.S. District Court for the Southern District of California against Direct Merchants Funding, LLC, doing business as Flash Advance of Fort Lauderdale, Florida, alleging the Florida company called him several times to offer services.

According to the complaint, in April 2017, Melingonis was damaged from receiving several unwanted calls on his cellular telephone. The plaintiff alleges Flash Advance illegally used an automatic telephone dialing system to call the plaintiff without prior consent.

Melingonis seeks trial by jury, $500 in statutory damages for each and every violation, $1,500 in treble damages for each and every violation, and all other just and proper relief.
