Coke hit with lawsuit over 'no added sugar' claims

NEW YORK (Legal Newsline) — A New York consumer has filed a class action lawsuit against Coca-Cola, alleging negligent misrepresentation.

Tara Casey of Poughkeepsie, New York, filed a complaint, individually and on behalf of all others similarly situated, March 24 in U.S. District Court for the Southern District of New York against Odwalla, Inc. and The Coca-Cola Company, alleging they falsely label their product as "no added sugar" to mislead consumers into purchasing their juice products.

According to the complaint, Casey purchased a juice product she thought was healthier than other juices because of it labeled as no sugar added. The plaintiff alleges the defendants deceived consumers into purchasing their product by labeling it as no added sugar when these products contain large amounts of sugar. 

Casey seeks trial by jury, compensatory damages, treble damages, interest, restitution, court costs and any relief the court grants. She is represented by attorneys Todd S. Garber and D. Greg Blankinship of Finkelstein, Blankinship, Frei-Pearson & Garber, LLP in White Plains, New York.
