Beer drinker says he was tricked into thinking Kona Brewing products brewed in Hawaii

SAN FRANCISCO (Legal Newsline) — A consumer has filed a class action lawsuit against a Hawaiian brewery that alleges several enterprises falsely promoted products as being brewed in Hawaii when, in fact, they're not. 

Theodore Broomfield filed a complaint on behalf of all others similarly situated on March 6 in the U.S. District Court for the Northern District of California against Kona Brewing Co. LLC, Kona Brew Enterprises LLC, Kona Brewery LLC and Craft Brew Alliance Inc., alleging that they falsely labeled their beer products.

According to the complaint, the plaintiff alleges that he suffered damages from being misled into purchasing a product that he believed was brewed in Hawaii. The plaintiff holds the defendants responsible because they allegedly used images of Hawaii and Hawaiian landmarks, and this deceived consumers into thinking the products were brewed in Hawaii when they were actually brewed in the continental United States.

The plaintiff requests a trial by jury and seeks damages, interest, restitution, injunctive relief, all legal fees and any other relief that the court deems just. He is represented by Barbara Rohr and Benjamin Heikali of Faruqi & Faruqi, LLP in Los Angeles.
