GrubHub accused of harassing texts

CHICAGO (Legal Newsline) — A Colorado man has filed a class action lawsuit against GrubHub, alleging violation of telephone harassment statutes.

Nicholas Amodeo of Denver filed a complaint, individually and on behalf of all others similarly situated, Feb. 17 in U.S. District Court for the Northern District of Illinois against GrubHub Inc. alleging that the Chicago corporation sent several text messages to the plaintiff's cellular telephone.

According to the complaint, in 2016, Amodeo suffered monetary damages from receiving several unwanted text messages from the defendant. The plaintiff alleges GrubHub failed to provide an opt-out option to the text messages it sent him.

Amodeo seeks trial by jury, injunctive relief, statutory damages of $500, treble damages of $1,500, all legal fees and all other relief the court deems just. He is represented by attorney Sergei Lemberg of Lemberg Law LLC in Wilton, Connecticut.
