Class action filed over alleged Enbrel side effects

LOS ANGELES (Legal Newsline) — An Orange County, California, consumer is suing a drug business, alleging breach of warranty, unfair competition and violation of state law.

B. Amburgey of Newport Beach, California, filed a class action complaint, individually and on behalf of all others similarly situated, Feb. 2 in U.S. District Court for the Central District of California against Caremarkpcs Health LLC and Does 1-10, alleging they failed to ensure that the specialty drugs are maintained within the required temperature range.

According to the complaint, Amburgey suffered side effects from taking the drug Enbrel that was ineffective due to the way it was stored. The plaintiff alleges the defendants failed to make sure that Enbrel was properly stored with the proper temperature required by FDA guidelines.

Amburgey seeks trial by jury, enjoin the defendant, restitution, all legal fees and all other relief the court deems just. She is represented by attorneys Caleb Marker and Hannah P. Belknap of Zimmerman Reed LLP in Manhattan Beach, California.
