Six consumers accuse Toyota of selling defective vehicles

LOS ANGELES (Legal Newsline) — Six consumers are suing Toyota, alleging breach of implied warranty, negligent misrepresentation and unjust enrichment.

Paul Stockinger, Elizabeth Stockinger, Gailyn Kennedy, Basudeb Dey, Brenda Flinn, and Eliezer Casper filed a class action complaint, individually and on behalf of all others similarly situated, Jan. 3 in U.S. District Court for the Central District of California against Toyota Motor Sales U.S.A. Inc., alleging the defendant manufactured defective vehicles and sold them to consumers.

According to the complaint, the plaintiffs suffered monetary damages from purchasing vehicles equipped with a defective HVAC system. The plaintiffs allege Toyota was aware of the design defect but chose to conceal this information from consumers and did not fix the defects.

The plaintiffs seek trial by jury, enjoin the defendant, injunctive relief, restitution, disgorgement, punitive damages, statutory damages, treble damages, exemplary damages, compensatory damages, all legal fees plus interest and all other relief the court deems just.
