NEWARK, N.J. (Legal Newsline) – A New Jersey borough has filed a class action lawsuit against field turf manufacturers over allegations their product is defective.
The Borough of Carteret filed a complaint on behalf of all others similarly situated on Dec. 14 in the U.S. District Court for the District of New Jersey against Fieldturf USA Inc., Fieldturf Inc. and Fieldturf Tarkett SAS, alleging unjust enrichment and violation of the New Jersey Consumer Fraud Act.
According to the complaint, the plaintiff alleges that The Borough of Carteret suffered damages from purchasing six defective synthetic grass fields from the defendant. The plaintiff holds Fieldturf USA Inc., Fieldturf Inc. and Fieldturf Tarkett SAS responsible because the defendants allegedly installed synthetic grass that degraded prematurely despite defendants' assurance the product would last 10 years or more.
The plaintiff requests a trial by jury and seeks enjoin the defendants, refund all unjust benefits plus interest, disbursements and reimbursement, compensatory and treble damages, plus any other relief as the court deems just.
