Maine consumers allege Electricity Maine engaged in scheme to charge higher rates

BANGOR, Maine (Legal Newslinle) – Two consumers have filed a class action lawsuit against electricity providers over allegations they conducted a scheme to charge customers higher rates.

Katherine Veilleux and Jennifer Chon filed a complaint on behalf of all others similarly situated on Nov. 18 in the U.S. District Court for the District of Maine against Electricity Maine LLC, Provider Power LLC, Spark Holdco LLC, Kevin Dean and Emile Clavet,  citing the Racketeer Influenced and Corrupt Organizations Act, Maine Unfair Trade Practices Act and other counts.

According to the complaint, Electricity Maine LLC is an electricity supply provider and enrolled nearly 200,000 households in Maine between 2011 and 2014 with its promises of cost savings. The suit states that the defendants instead cost ratepayers at least $35 million.

The plaintiffs holds Electricity Maine LLC, Provider Power LLC, Spark Holdco LLC, Dean and Clavet responsible because the defendants allegedly participated in a scheme to deceive consumers by sending re-enrollment contract notices via email to conceal higher rates.

The plaintiffs request a trial by jury and seek judgment against the defendants for compensatory and consequential damages, court costs, punitive damages and any further relief this court grants. They are represented by Thomas F. Hallett, Timothy E. Zerillo, David A. Weyrens and Benjamin N. Donahue of Hallett, Zerillo & Whipple P.A. in Portland, Maine and Robert P. Cummins of the Cummins Law Firm in Chicago.
