Lifestation Inc. accused of making unsolicited calls to sell medical alert systems

CHICAGO (Legal Newsline) – A Union, New Jersey, business is facing a class action lawsuit from an Illinois man over allegations it made unsolicited calls to his cellphone.

Scott Dolemba filed a complaint on behalf of the class on Nov. 4 in the U.S. District Court for the Northern District of Illinois against Lifestation Inc. and Does 1-10 citing the Telephone Consumer Protection Act and the Illinois Consumer Fraud Act.

According to the complaint, the plaintiff alleges that beginning in October, he suffered damages from receiving unsolicited phone calls on his cellular telephone from the defendant in an attempt to solicit a medical alert system. The plaintiff holds Lifestation Inc. and Does 1-10 responsible because the defendants allegedly used an automatic telephone dialing system to call the plaintiff without authorization.

The plaintiff seeks statutory damages, injunction against the defendant, all legal fees and any other relief as the court deems just. He is represented by Daniel A. Edelman, Cathleen M. Combs, James O. Latturner, Dulijaza (Julie) Clark and Heather Kolbus of Edelman, Combs, Latturner & Goodwin LLC in Chicago.
