Oregon consumer accuses pillow business of fraud

PORTLAND, Ore. (Legal Newsline) — An Oregon woman is suing a Minnesota pillow business, alleging fraud.

Jill Brunelle filed a class action complaint, on behalf of herself and all similarly situated persons, Oct. 18 in U.S. District Court for the District of Oregon against My Pillow Inc., alleging it obtained profit through unfair or deceptive trade or commerce.

According to the complaint, in 2014 Brunelle and class members were enticed by the defendant's buy one get one free advertisement campaign. The suit says, unbeknownst to Brunelle and class members, they were not getting two pillows for the price of one. Instead, the lawsuit states, My Pillow was inflating the regular price of the first pillow to approximately or exactly twice its regular price, thereby passing on the cost of the free pillow on to the consumer. 

The plaintiff alleges My Pillow constituted a false or misleading statement about a promotion to publicize a product and inflated the price of its products. 

Brunelle seeks trial by jury, judgment in her favor, certifying the case as a class action, appoint Brunelle and her lawyer as class representative/counsel and injunctive relief. She is represented by attorney Rick Klingbeil of Portland.
